Recently, multiple media outlets including CBS New York and BBC reported that the New York City Department of Consumer and Worker Protection (DCWP) launched an investigation into Starbucks starting in 2022 and found that Starbucks had repeatedly violated the Fair Workweek Law.

According to reports, the DCWP said that after receiving dozens of complaints from Starbucks employees, it launched an investigation in 2022 into more than 300 Starbucks stores in New York City and found that since 2021 Starbucks had not provided stable schedules to store employees and had reduced employee hours by 15% or more, making it difficult for them to make a living. In addition, the company often refused overtime for employees, forcing them into part-time status.

The Fair Workweek Law stipulates that fast-food companies may not arbitrarily change employees' fixed schedules and that employees have the right to refuse additional hours. The law also requires companies to offer additional shifts to existing employees before hiring new ones.

So after an investigation lasting several years, the DCWP said Starbucks violated the Fair Workweek Law more than 500,000 times. Its commissioner said, "The Fair Workweek Law provides important protections for workers, such as ensuring predictable scheduling so they can plan their lives and have stable incomes. But Starbucks chose to ignore these rights and put its own profits first."

In response to the allegations, Starbucks, which agreed to a settlement, will pay $35.5 million (equivalent to 251 million yuan) in compensation to more than 15,000 employees who worked at hundreds of stores in New York City between July 2021 and July 2024.

In other words, under the settlement agreement, all Starbucks employees in New York City during the period from July 4, 2021, to July 7, 2024, will receive compensation of $50 per week. For example, an employee who worked for a year and a half will receive $3,900 (equivalent to 27,500 yuan). If employees believe they still experienced scheduling violations after July 7, 2024, they may submit complaints to the DCWP to apply for additional compensation.

In addition, the settlement agreement also requires Starbucks to pay $3.4 million (equivalent to 24 million yuan) in civil penalties and litigation costs. That is, Starbucks must pay a total of $38.9 million (equivalent to 275 million yuan) in this settlement process.

Local officials said this is the largest and highest-value worker rights settlement in New York City history, calling it a "landmark" settlement agreement, and said, "No matter how big your business is or how much profit your company makes, if you violate our workers' rights, you will pay the price."

Regarding this matter, Starbucks said in a statement on its website on Monday that the settlement money "is to ensure compliance, not to recover unpaid wages." The company said it is committed to complying with the Fair Workweek Law, but added that meeting these regulatory requirements is not easy. Starbucks said almost any adjustment to schedules could be regarded as a potential issue, including temporary changes caused by employees taking leave on short notice.
